AGENCY ROLE
- KAX and its employees, contractors and affiliates (“KAX”) act only as an agent for airlines, hotels, cruise lines, tour operators, and the like. KAX does not own, operate, profit, or control in any way those entities.
- KAX’s vendors and suppliers are independent contractors, not employees.

SUPPLIER RESPONSIBILITY DISCLAIMER

Client agrees that:
- suppliers and independent contractors control their own schedules, services, and operations.
- KAX is not responsible for cancellations, delays, bankruptcies, strikes, weather, supplier errors, acts of God, governmental acts, civil unrest and similar force majeure acts.

PAYMENT & BOOKING TERMS
- Your KAX advisor will inform you of any required deposits and payment deadlines. Failure to meet these deadlines and/or failure to make deposit and/or payments in full, can result in cancellation of your trip and, in some cases, forfeiture of any money you have paid to that point.
- KAX will provide you with expected costs for the trip you have specified. You are responsible for verifying the list of expected costs includes everything you discussed with your KAX advisor and want
- Your KAX advisor will tell you whether your travel plans require payment in full or a deposit. To confirm a reservation or price, you must first make that payment.
- Currency fluctuations may affect the final, actual price you pay.

CANCELLATION AND REFUND POLICY
- You acknowledge cancellation policies and penalties vary by service, industry and supplier. Many bookings are nonrefundable.
- Suppliers and vendors who are willing to refund all or a portion of your fees and costs almost always require significant advance notice of your plan changes. The earlier you advise us of your changing plans, the greater the likelihood we will be able to help you secure a partial or complete refund or change the dates of your travel. You should expect, at a minimum, fees to change your transportation.

CHANGE FEES
- You understand airlines and other transportation providers, as well as hotels, ground transfer, destination servicers and events will most likely charge fees to change your reservation, if they are willing to change your reservation at all. You understand and acknowledge we can advocate for you, but the decision rests with the service provider.
- If your change of plans results from a decision you made or an event that occurred in your life, you are solely responsible for any fees and forfeitures that occur consequently.

TRAVEL INSURANCE
- You understand KAX strongly recommends you obtain travel insurance, particularly for any significant trip or any trip you cannot afford to lose. You understand travel insurance protects you from events that are both inside and outside your control, and can potentially save you substantial money.
- You understand and acknowledge KAX will not be responsible for any loss you may suffer as a result of a voluntary or involuntary change of plans, inability to travel for any reason, including weather, war, pestilence, or other event beyond human control.
- You understand you must either accept or decline travel insurance for us to make your travel plans. KAX cannot make the decision for you.

SUPPLIER AND SCHEDULE CHANGES
- You understand and agree that airlines, hotels and cruises may change schedules and availability with little to no notice. Although KAX uses trusted and vetted suppliers and vendors only (unless otherwise specified), KAX has no control over the schedules of those suppliers and vendors.
- In the event, a supplier or a vendor scheduled to provide you a service or other component of your travel is unable to meet its obligation, KAX will work to provide you with comparable alternatives. KAX provides this as a service and not because of any affiliation with the suppliers or vendors, and not because of potential liability or responsibility.

DOCUMENTATION RESPONSIBILITY
- You are responsible for ensuring you have a passport that does not expire within 6 months of your expected return to the US from any international destination. An adult traveling with a minor child is responsible for the child’s passport and any other appropriate documentation.
- All passports must have at least 3 blank pages.
- KAX will provide you with advice and resources, but you are responsible for ensuring you have appropriate visas, vaccinations, proof of meeting those and any other requirements for entry into your destination country. You understand that proof may include expiration dates and other indicators of meeting the entry requirements.
- KAX is not responsible if you are denied boarding or entry into a destination country because you failed to have sufficient or proper documentation.
- You understand sufficient or proper documentation may be time-consuming to obtain and delaying until close to the time of departure may foreclose your ability to travel.

HEALTH AND MEDICAL RESPONSIBILITY
- You understand you are solely and exclusively responsible for safe and healthy travel. KAX cannot advise you whether travel with a particular medical condition is safe or advisable.
- If you or a traveling companion have a medical condition that will require special care or attention at your destinations (such as an allergy to certain foods) we will provide that information at your request to appropriate vendors and suppliers during your travel. It is your responsibility upon arrival to ensure appropriate preparations and precautions are taken.
- If you have a serious medical condition, that requires complicated or protracted, medical treatment, KAX does not advise international travel. If you determine to travel despite that advice, KAX urges you to be vigilant in ensuring appropriate treatment and/or precautions are available at your destination, and urges you to purchase emergency medical evacuation insurance.
- Under no circumstances is KAX responsible for any injury or illness that befalls you or your traveling companions, even if you advised us of a pre-existing medical condition and we notified vendors and suppliers on your behalf.

LIABILITY
- In the event of a dispute between you and KAX, KAX’s maximum liability to you is the total amount of fees you paid to KAX in the preceding six months for travel related professional services. In the event you are a contracted client with KAX, the total maximum liability will be the total amount of fees you paid to KAX in the preceding 12 months for travel related professional services.
- Under no circumstances will KAX be liable to you for consequential damages, resulting from travel KAX arranges for you, even if those damages result from KAX’s negligence, or gross negligence.

CLIENT CONDUCT
- KAX reserves the right to terminate its relationship with you at any time if you are rude, abusive, or disruptive. In such a situation, you will not be entitled to any refund of fees.

ERRORS AND OMISSIONS
- You are responsible for your travel. KAX will provide you with written itineraries. You are responsible for verifying the information when you receive the itinerary and ensuring it is the travel you expected. If KAX has made an error, you must notify us immediately. Failure to do so can result in you losing fees through cancellation or trip changes.
- You are responsible for verifying and validating tickets, reservations, and any special events at your destination. You must notify us immediately of any errors.
- You are responsible for downloading applications from airlines, cruise lines, and other transportation providers to ensure you have the latest, up to date, change information.

CHARGEBACK AND PAYMENT DISPUTES
- You agree to contact KAX in writing an attempt to resolve in good faith any dispute or concern about services you may have prior to initiating a chargeback. You agree that failure to do so will be grounds for your credit card company denying the charge back.
- You understand and agree that supplier penalties will apply in the event of any successful chargeback, and that KAX will not be responsible for those fees.

GOVERNING LAW AND VENUE
- You agree that in the event we cannot resolve our dispute, either party may request mandatory mediation. Such mediation shall be for one full day, in person in Miami, Florida, through JAMS. If JAMS is unavailable, a similar organization can substitute.
- You agree that any lawsuit can only be filed after mediation and that the state and federal courts sitting in Miami/Dade County Florida will be the appropriate jurisdiction and venue for any such lawsuit.
